Overview

This Privacy Notice describes the information collection, use, and disclosure practices of Annuity & Insurance Leads LLC ("we," "us," "our," or the "Company") and our websites and applications, including www.joinailifeagency.com and any other websites or platforms we may operate now or in the future (the "Platform").

The Platform provides information and tools to licensed insurance agents and prospective insurance agents ("Agents"). We also receive information about individuals interested in insurance or financial products ("Consumers") and make that information available to licensed Agents who assist with product selection and purchase. We may also work with Lead Vendors—companies that collect Consumer inquiries and pass them to Agents and Company representatives. Lead Vendors must obtain appropriate consent from Consumers to be contacted regarding specific products before providing us with those Consumers' information.

"Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked—directly or indirectly—with a particular consumer or household.

Applicability of HIPAA and GLBA

Because we facilitate the sale of a range of insurance products, some information we process on behalf of Agents may be governed by other laws, including the Health Insurance Portability and Accountability Act ("HIPAA") and the Gramm-Leach-Bliley Act ("GLBA") and related state laws.

We may act as a Business Associate (as defined by HIPAA) if we receive Protected Health Information ("PHI") from Lead Vendors or on behalf of a Covered Entity. In that role we use and disclose PHI only to provide services for or on behalf of the Covered Entity. For details regarding PHI, please review the applicable health plan's Notice of Privacy Practices.

When we receive information pertaining to certain insurance or financial products, we may collect non-public personal financial information regulated by GLBA. For details on that information, please review the GLBA notice issued by the relevant financial institution.

This Privacy Notice applies to Personal Information not covered by HIPAA or GLBA.

Personal Information We Collect / Sources of Personal Information

Below are the categories of Personal Information we may collect (directly or indirectly) and typical sources. We may also receive information from service providers and vendors (e.g., analytics providers).

Contact Information

Consumers' and Agents' name, phone number, email, and Consumers' postal address.

Sources (Consumers): Lead Vendors, Agents, carriers, data brokers, agencies.

Sources (Agents): Agents or marketing organizations in the Agents' hierarchy.

Login Credentials

Username and password* if you create an account.

Identification Information

Agents: National Producer Number and Social Security number (collected when Agents begin working with us).

Consumers: driver's license, Social Security number, or similar IDs provided to an Agent in connection with an application.

Demographic Information

Consumers' age, date of birth, marital status, language preference, ethnicity, race, and sex/gender (from Lead Vendors, carriers, Agents, data brokers, or agencies).

Health Information

Consumers' health information provided during discussions with an Agent (e.g., details relevant to underwriting for life or health products).

Sensory Information

Audio recordings of Consumer calls with our representatives and Agents; we may also access video snippets of website activity evidencing consent (from Lead Vendors, Agents, carriers, and agencies).

Commercial Information

Product inquiries and application information submitted by you or provided by Lead Vendors, Agents, carriers, data brokers, advertising and/or social media networks, or agencies; product purchased and carrier.

Internet or Other Similar Network Activity

Automatically collected details about interactions with the Platform (e.g., referring site, subsequent site, session duration, device ID, IP address). We may also receive this from advertising networks.

Geolocation Data

Geolocation, which may include precise geolocation* (collected automatically and/or from advertising networks).

Educational and Professional Information

From data brokers: Consumers' education, profession, income, product preference, consumer behavior, and asset ownership (used for offline marketing).

From Agents: professional information collected when Agents begin working with us.

* Items marked with an asterisk may be considered sensitive under certain state laws.

We may partner with payment processors to provide services to Agents on the Platform. We do not collect biometric information. Your information may also be provided by your spouse or another family member.

How We Use Personal Information

We may use or disclose Personal Information to:

  • Operate and maintain the Platform;
  • Communicate with you about the Platform;
  • Connect Consumers with independent Agents regarding products in which the Consumer expressed interest;
  • Address inquiries and provide support;
  • Process transactions;
  • Tailor content and communications;
  • Analyze usage of our products and services;
  • Develop new products and services;
  • Comply with legal obligations;
  • Protect our rights, property, and safety, or those of others; and
  • Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale/transfer of assets (including during bankruptcy or similar proceedings). You consent to such transfers, and we may assign all rights and obligations under this Privacy Notice as part of such a transaction.

From time to time, we may contact users via email or mail with announcements, offers, alerts, confirmations, surveys, and other communications. To stop marketing communications, use the unsubscribe link (if available) or contact us using the information below.

We may also contact Agents, Consumers, and other users via text message, but only if they opt in and only within the scope of their consent.

How We Share Personal Information

We may disclose all categories listed in Personal Information We Collect to the third parties below to facilitate the sale of insurance and/or financial products to interested Consumers:

Service Providers. Vendors that perform services for us (e.g., payment processors, email/SMS providers, hosting, CRM and operational tools).

Business Partners. Our affiliates in the insurance/financial industry, carriers, and organizations involved in product distribution (e.g., marketing organizations).

Law Enforcement/Government/Legal. To comply with law or legal process, or to assist law enforcement.

Independent Agents and Advisors. Agents/advisors receive Consumer information relevant to the Consumer's request.

Data Analytics and Advertising Providers. These parties may collect information over time and across sites/apps/devices for advertising and analytics. See Cookie Policy below.

Some targeted advertising activities may be considered a "sale" or "sharing" of Personal Information under certain state laws. See Your State Privacy Rights for choices.

Cookie Policy

The Platform may use cookies, pixel tags, web beacons, and similar technologies (including those placed by third parties such as advertising networks) to operate and enhance the site and tailor content/ads. You can set your browser to refuse or alert you about cookies; some Platform features may not function properly without them. Our Platform does not recognize "Do Not Track" signals, but it may recognize other opt-out preference signals such as Global Privacy Control (GPC).

Children Under 16

The Platform is not intended for children under 16, and we do not knowingly collect information from anyone under 16. If we learn we collected Personal Information from a child under 16 without verified parental consent, we will delete it. If you believe we have such information, please contact us.

Your State Privacy Rights

State consumer privacy laws may provide residents with additional rights regarding our use of their Personal Information.

To appeal a decision regarding a request, email info@lenhofffinancial.com with "APPEAL" in the subject and a short description of your prior request and desired outcome. We may request additional information to locate your prior request.

Sale and Sharing of Personal Information

We facilitate the sale of insurance and financial products and may engage in targeted advertising that could be deemed a "sale" or "sharing" of Personal Information under some state laws. In the last 12 months, we may have "sold" or "shared" the categories of Personal Information listed in Personal Information We Collect with advertising networks, data analytics vendors, carriers, and Agents.

Retention of Data

We retain Personal Information where we have an ongoing legitimate business or legal need. Retention varies by data type and considers: (i) legal/contractual requirements; (ii) whether the data is necessary to provide the Platform; and (iii) whether users would reasonably expect retention until removal or account closure. When no longer needed, we delete or anonymize the data where feasible; otherwise we securely store it until deletion is possible (e.g., in backups).

Data Security

No method of transmission or storage is completely secure. We use appropriate safeguards designed to protect Personal Information, but we cannot guarantee absolute security.

Third-Party Applications and Integrations

Our Platform uses third-party applications and integrations. We are not responsible for those third parties and encourage you to review their privacy notices before using our Platform or otherwise engaging with us.

Updates to This Privacy Policy

We may revise this Privacy Notice from time to time. If we make material changes, we will notify you by email or by posting a notice on the Platform prior to or on the effective date. By continuing to use the Platform after changes become effective, you acknowledge the revised Privacy Notice.

Your Privacy Rights – California (CCPA/CPRA)

To the extent the law applies to the Company, California residents have the rights described below (subject to legal exceptions). "Personal Information" has the meaning provided in the CCPA.

We have collected the categories described in Personal Information We Collect and disclosed them to the third parties listed in How We Share Personal Information for the business purposes identified there and in How We Use Personal Information. These categories include: identifiers; categories in Cal. Civ. Code § 1798.80(e); protected class characteristics; commercial information; geolocation; audio/electronic/visual information; internet activity; professional or employment information; and sensitive Personal Information (as noted above).

As noted under Sale and Sharing of Personal Information, certain activities may be deemed "selling" or "sharing." To opt out, use the "Do Not Sell or Share My Personal Information" link on our site. We do not use or disclose sensitive Personal Information for purposes other than those permitted by Cal. Code Regs. tit. 11, § 7027(m).

Your CCPA rights include (subject to verification and exceptions):

  • Access/Know (including categories, sources, purposes, categories "sold"/"shared," categories disclosed for a business purpose, and third-party categories);
  • Copy/Portability;
  • Correction;
  • Deletion;
  • Opt-Out of "selling"/"sharing" Personal Information; and

Verification & Authorized Agents

We may require sufficient information to verify your identity (or your agent's authority) before acting on a request and may deny requests we cannot verify. If you use an authorized agent, we may require written authorization and separate identity verification unless your agent holds power of attorney.

The "Do Not Sell or Share My Personal Information" link should appear conspicuously on our homepage (e.g., header/footer), near links to this Privacy Policy and our Terms.

Your Privacy Rights – Colorado, Connecticut, Utah, Virginia (and similar state laws)

Where applicable, residents may have the following rights (subject to exceptions and verification): confirm processing; access/portability; correction; deletion; opt out of targeted advertising, sales, or certain profiling; limit processing of sensitive data (where applicable); and freedom from discrimination for exercising rights.
